1. The initial deposit is 50% of the total quoted GST inclusive price. The deposit reserves the Customer’s agreed due date and is NON-REFUNDABLE.

  2. The deposit must be paid within 7 days of the quote/invoice date, unless agreed otherwise with Angie’s Cake Emporium. If not paid the booking may be removed from the booking calendar and order book which could result in the Customer’s allocated space being filled by another booking. Any deposits paid will NOT BE REFUNDED.

  3. Final payment for any outstanding monies is due NO LESS THAN 14 DAYS PRIOR to pick up or delivery.

  4. If final payment is not received 7 DAYS PRIOR to pick up or delivery, this contract will be immediately cancelled and any monies paid will NOT BE REFUNDED.

  5. The date of the final payment is the FINAL DATE for any changes of size, style, design and flavours to the original order. Any changes after this date cannot be guaranteed and additional charges may apply.

  6. All payments can be made by either direct Bank Deposit, Cash, EFTPOS or Credit Card (In person or over the phone).

  7. Angie’s Cake Emporium will not be held responsible for any damage to the cakes, cupcakes or desserts supplied and displayed after set up is complete, where set up has been asked for and provided. The Customer’s venue is responsible for providing an appropriate and stable setting and environment for the cakes, cupcakes or desserts supplied as they can sometimes be heavy and require a sturdy table and an optimal room temperature of approx. 23-25 degrees celsius or below. Cakes are NOT to be refrigerated.

  8. If the Customer or their representative elect to pick up and set up the cakes, cupcakes or desserts supplied, they assume ALL liability and responsibility for the condition of the cakes, cupcakes or desserts once it leaves the possession of Angie’s Cake Emporium. Any damage incurred to the cakes, cupcakes or desserts supplied after pick up or delivery and the Customer elects for Angie’s Cake Emporium to make any repairs then a payment of $100.00 per hour will be payable, with the first hour being due in prior to the commencement of any repair work.

  9. If REAL FRESH FLOWERS are to be provided, the Customer acknowledges that these Real Fresh Flowers are not food products, they are not to be eaten and may contain pesticides, insects, dirt or other contaminants. Angie’s Cake Emporium accepts no responsibility for any effect such items will have on the cakes, cupcakes or desserts supplied.

  10. Angie’s Cake Emporium guarantees the quality of the edible cakes, cupcakes or desserts supplied for a period of three (3) days past pick up or delivery, provided the cakes, cupcakes or desserts supplied are refrigerated once cut. Past this date, and if not refrigerated, Angie’s Cake Emporium cannot guarantee the quality of cakes, cupcakes or desserts supplied since they are food items that will deteriorate past this point in time.

  11. If any part of the cakes, cupcakes or desserts supplied are to be kept to be eaten at a time in the future, that this be made clear to Angie’s Cake Emporium from the beginning to ensure that the cakes, cupcakes or desserts supplied can be or are suitable for freezing. If freezing is an option Angie’s Cake Emporium recommends that the portion to be immediately wrapped in cling film and frozen within 24 hours of being cut. Angie’s Cake Emporium does not guarantee the quality of the frozen cakes, cupcakes or desserts supplied beyond a period of six (6) months, as per the Australian Food Standards.

  12. If for any reason the Customer is unhappy with the taste of cakes, cupcakes or desserts supplied once it has been cut then it must be returned to Angie’s Cake Emporium within two (2) business days for assessment. If the cakes, cupcakes or desserts supplied are deemed to be below standard, then the Customer will be offered another cake or refund. If the cake is not returned within the two (2) business day timeframe Angie’s Cake Emporium will not be able to fairly asses the quality of the cake and as such not be able to offer any form of compensation.

  13. On most occasions Angie’s Cake Emporium will photograph the cakes, cupcakes or desserts supplied and reserves the right to use such photographs for display or promotional purposes without any compensation being due to the Customer(s). Photographs will not be published until after the event the cakes, cupcakes or desserts supplied for has occurred.

  14. The product used within the cakes, cupcakes or desserts supplied may contain or come into contact with milk, wheat, nuts, soy and other allergens. If the Customer has any allergies they are expected to make Angie’s Cake Emporium aware of them BEFORE confirming their order.

  15. The Customer acknowledges their understanding that the cakes, cupcakes or desserts supplied are created from primarily made from products such as milk, eggs, chocolate and sugar, which are affected by many factors out of the control of Angie’s Cake Emporium e.g. weather, humidity, air escaping from within the cake during transport and as such small imperfections may be visible on the cakes, cupcakes or desserts supplied. Angie’s Cake Emporium will endeavour to avoid this as much as possible.

  16. The Customer acknowledges their understanding that Angie’s Cake Emporium or its representative will use its best efforts and steps to avoid any damage during transport. Unforeseen circumstances and factors outside the control of Angie’s Cake Emporium or their representative can affect the finish of the delivered product. If any damage occurs to the cakes, cupcakes or desserts supplied during transport, Angie’s Cake Emporium will endeavour to repair the cake to the best possible standard however, the Customer acknowledges that some imperfections may remain.

  17. Performance of this agreement is contingent upon the ability of Angie’s Cake Emporium to complete the agreement and is subject to labour disputes or strikes, accidents, Acts of God and other causes beyond the control of Angie’s Cake Emporium.

They also understand that Angie’s Cake Emporium will create my cakes, cupcakes or desserts SOLEY based on the information contained within the QUOTE/INVOICE provided. Any information that has not been included is likely to NOT be included in the final cakes, cupcakes or desserts supplied.

WHOLESALE CONFIRMATION
Wholesale customers understand that all information necessary to make the agreed cakes, cupcakes or desserts, is contained within this document. They also understand that Angie’s Cake Emporium will create my cakes, cupcakes or desserts SOLEY based on the information contained within the QUOTE/INVOICE provided. Any information that has not been included is likely to NOT be included in the final cakes, cupcakes or desserts supplied. Wholesale customers also agree to the payments terms and due dates contained on each of their invoices.
